These Terms and Conditions ("Terms," "Agreement") govern your access to and use of the Medhavi Coaching Institute website, student portal, online examination platform, and all related services (collectively, the "Services") operated by Medhavi Coaching Institute ("Medhavi," "we," "us," or "our").

By accessing, browsing, registering for, or using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use our Services.

1.3 Account Security: You are solely responsible for maintaining the confidentiality of your account credentials (username and password) and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security. Medhavi will not be liable for any loss or damage arising from your failure to protect your credentials.

2. Use of the Services

2.1 Permitted Use: Medhavi grants you a personal, non-exclusive, non-transferable, and revocable license to access and use the Services strictly for your personal, non-commercial educational purposes.

2.2 Prohibited Conduct: You agree not to:

• Use the Services for any unlawful purpose or in violation of any local, state, national, or international law.
• Attempt to hack, destabilize, or adapt the Services, or alter another website to falsely imply it is affiliated with Medhavi.
• Share your login credentials with third parties or allow others to take exams on your behalf.
• Harvest, scrape, or systematically extract data, test questions, or study materials from the platform.
• Transmit any viruses, malware, or destructive code.

3. Online Examinations and Academic Integrity

3.1 Examination Rules: When participating in online assessments or examinations through the portal, you agree to adhere strictly to the rules of conduct provided prior to the exam.

3.2 Proctoring and Monitoring: Medhavi reserves the right to use automated and manual proctoring technologies—including audio, video, and screen monitoring—to ensure the integrity of its examinations. By taking an online exam, you consent to this monitoring.

3.3 Zero Tolerance for Malpractice: Any form of cheating, use of unauthorized materials, impersonation, or attempt to manipulate the examination software will result in the immediate cancellation of your test, forfeiture of fees, and potential expulsion from the institute.

4. Intellectual Property Rights

4.1 Ownership: All content provided through the Services, including but not limited to study materials, video lectures, test papers, questions, graphics, logos, software, and interface designs, is the exclusive property of Medhavi Coaching Institute and is protected by Indian and international copyright and trademark laws.

4.2 Restrictions: You may not copy, reproduce, distribute, publish, display, modify, create derivative works from, or exploit any part of our intellectual property without prior written consent from Medhavi Coaching Institute. Downloading material for offline studying is permitted only where expressly indicated.

5. Fees, Payments, and Refunds

5.1 Payment Terms: Access to certain premium features, courses, and examination series requires payment of fees. All fees must be paid in full prior to the commencement of the respective course or service.

5.2 Pricing: We reserve the right to change our fee structure at any time. Any changes will be communicated clearly and will not affect subscriptions or courses already paid for.

5.3 Refund Policy: All refund requests will be processed strictly in accordance with our separate Refund and Cancellation Policy. Please review that policy before making any payments.

6. System Availability and Maintenance

While we strive to ensure that our portal and examination platform are available 24/7, we do not guarantee uninterrupted access. The Services may occasionally be down for scheduled maintenance, updates, or technical emergencies. Medhavi is not liable for any inconvenience, academic loss, or other damages resulting from system downtime.

7. Termination and Suspension

7.1 Termination by You: You may stop using our Services at any time by requesting account deletion, subject to any outstanding fee obligations.

7.2 Termination by Us: Medhavi reserves the right to suspend or terminate your access to the Services at any time, without notice, for conduct that we believe violates these Terms, is harmful to other users, or damages the interests of the institute (e.g., academic malpractice or sharing of premium content).

8. Limitation of Liability

To the fullest extent permitted by applicable law, Medhavi Coaching Institute, its directors, educators, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of academic opportunity, or emotional distress arising out of your use of or inability to use the Services.

9. Indemnification

You agree to defend, indemnify, and hold harmless Medhavi Coaching Institute from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your access to or use of the Services or your violation of these Terms.

10. Governing Law and Dispute Resolution

These Terms and any dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with the laws of India. Any legal actions or proceedings related to these Terms shall be brought exclusively in the competent courts located in Dibrugarh, Assam, and you consent to the jurisdiction of such courts.
